1. Acceptance of These Terms

By accessing or using the Northbay Automations website or requesting our services, you agree to these Terms of Service. If you do not agree with these Terms, please do not use our website or services.

2. Our Services

Northbay Automations provides business automation services, including voice agents for missed and after-hours calls, customer intake, callback requests, scheduling integrations, and related technology services.

The specific services provided to a customer may vary depending on the customer's business, requirements, and selected service package.

3. Free Demos and Trials

We may offer prospective customers free demonstrations, examples, or a seven-day voice agent trial with up to three hours of AI call time, whichever limit is reached first. The trial starts when the agreed call forwarding is activated. We will discuss how calls are handled if the trial limit is reached before the trial begins. No paid service starts automatically; a customer must accept a separate quote to continue.

Demo functionality may be limited and may not represent the final configuration of a production automation.

4. Pricing and Payment

Paid service pricing, included call minutes, treatment of usage beyond the included amount, and any setup fees are communicated in a quote before the customer agrees to paid service.

Ongoing maintenance, monitoring, or optimization fees may apply depending on the service selected.

Third-party services, software, communication providers, hosting, API usage, messaging, or other external costs may be billed separately when applicable.

5. Customer Responsibilities

Customers are responsible for providing accurate information and reasonable access to the systems, accounts, applications, and information necessary to configure their requested automation.

Customers are responsible for the accuracy of their business information and for reviewing the call routing, approved answers, scheduling rules, and follow-up process before launch. Northbay and the customer must agree on caller disclosures, recording or transcript settings, consent handling, and retention before any voice agent is activated. The customer is responsible for its own customer-facing privacy notice and lawful use of the service.

6. Third-Party Services

Our automations may connect with third-party services such as email providers, databases, scheduling platforms, form providers, telephone carriers, speech and AI voice services, automation platforms, and other software. The specific providers used for a customer implementation are identified during setup.

Northbay Automations does not control third-party services and is not responsible for outages, changes, pricing, restrictions, security incidents, or other issues caused by third-party providers.

7. Automation Limitations

Automation systems depend on the availability and proper operation of connected services, software, internet connectivity, APIs, and customer-provided information.

While we make reasonable efforts to build reliable workflows, we do not guarantee that an automation will operate without interruption, errors, delays, or failures.

8. No Guarantee of Business Results

Our services are intended to improve business processes and reduce repetitive work. We do not guarantee a specific number of leads, customers, sales, revenue, savings, response rates, or other business results.

9. Acceptable Use

You may not use our website or services for unlawful, fraudulent, abusive, harmful, or deceptive activities.

You may not attempt to interfere with the operation or security of our website, submit malicious code, abuse public endpoints, circumvent security controls, or attempt unauthorized access to our systems.

10. Intellectual Property

The Northbay Automations website, branding, content, designs, code, and materials provided by Northbay Automations remain the property of Northbay Automations or their respective owners unless otherwise agreed in writing.

Customer-specific work may be subject to separate agreements regarding ownership, licensing, or use.

11. Confidential Information

We will make reasonable efforts to protect confidential business information provided to us for the purpose of delivering our services. Customers should not provide information that is not necessary for the requested service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Northbay Automations will not be liable for indirect, incidental, consequential, special, or lost-profit damages arising from the use of our website or services.

Our services are provided on an “as is” and “as available” basis unless otherwise agreed in writing.

13. Termination

Either party may discontinue a service according to the terms of the applicable service agreement. We may suspend or terminate access to our website or services if necessary to prevent abuse, security issues, unlawful activity, or other violations of these Terms.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy.
